There is / body in focus of our committee scan today:

Committee on Family Matters, Youth Policy, Sports and Tourism

The committee considered the problem of compliance with the requirements of Ukrainian legislation regarding the protection of children’s rights to adequate housing.

The head of the committee stressed at the meeting that this right is protected by the UN Convention and the Law of Ukraine "On protection of childhood".  However, the relevant rules do not work in all cases. He then noted that children are left without a shelter in various cases - due to their parents' debts to banks and other financial institutions, because of parental conflicts or fraudulent use of housing for orphans and children deprived of parental care.

The legislation establishes certain protectors for the said housing rights, but they do not work in all cases. For children, the most dangerous case is a so-called mortgage foreclosure via out-of-court settlement on the basis of a contract that changes the property owner, then resulting in a forcible seizure of the property. The committee head stressed that the problem of misusing the housing of orphans and children deprived of parental care is a problem of particular attention.

The committee sitting was attended by citizens whose children had lost their right to housing through various fraudulent activities. They all have picketed the presidential administration, demanding protection of their rights, while throng of other victims continues picketing as they got roofless with children in the direct sense of the word.

The party discussed a wide range of problems that arise in the relationship between the victims on both sides.

A representative of the Ukrainian Parliament Commissioner for Human Rights  Aksana Filipishina suggested that the Ministry of Social Policy, the Ministry of Justice, the Ministry of Internal Affairs all together develop a mechanism for protecting the housing rights of children and provide relevant explanations to their structural divisions, guardianship and custodianship authorities, and state registrars.

Summing up the discussion, the committee head noted that there are two ways of solving the problem - making changes to Ukrainian legislation or resolving the problem through decisions of the Cabinet of Ministers and relevant central executive authorities. He promised that the committee would appeal to the Prime Minister to make the necessary decisions as soon as possible.

The discussion resulted in a committee's decision with clear proposals to the Cabinet of Ministers and other central executive bodies, taking into account of which is capable of making an effective mechanism for protecting the housing rights of children.
