Morning session's over

The Chairperson of the Verkhovna Rada of Ukraine Andriy Parubiy opened the morning session.

Opening the session, he congratulated all Ukrainians on Embroidery Day (Vyshyvanka Day), which is traditionally celebrated every third Thursday in May.

Parliamentarians continued to hammer away at the amendments to certain legislative acts on health care and organs transplantation and other human anatomical materials, which had been pre-filed through the bill under No. 2386a-1.

On organs transplantation: Draft bill No. 2386a-1

Taken on the second reading was there the bill amending certain legislative enactments of Ukraine on health care and transplantation of organs and other human anatomical materials.

The new law improves Ukraine’s system of transplant service.

This law applies to transplantation of human anatomical materials, carrying out of activities related to transplantation, receipt of human anatomical materials for making bio-implants, framing conditions for the use of xenoimplants.

The law aims to refine the following segments of the area in question:

- the terminology system: by introducing some new crucial definitions;

- the accreditation procedure for health care and scientific establishments engaged in transplantation activities;

- the system of providing foetal materials for further transplantations;

- the procedure for taking homo-transplants from living donors (including establishment of “ethics committee” responsible for attesting the donors’ will to donate organs and the like).

The law improves existing and establishes new principles, conditions and procedures for application of transplantations. The law prohibits commercialization in the field of transplantation and advertising of organs and/or other anatomical material.

The law grants the right to carry out transplantation activities to health facilities and academic institutions of all forms of ownership.

The law constitutes the principles of its activities for the Unified State Information System for Transplantation and establishes the legal framework for the implementation of "cross-donation" when taking homo-transplants from living donors.

The legislative act introduces the "List of re-generable anatomical materials".

The law imposes more stringent liability for violating transplant legislation to prevent illegal transplantation and trafficking in organs and/or other anatomical materials by introducing appropriate amendments to the Criminal Code of Ukraine.

The law improves the legal procedure for obtaining an "explicit consent" ("presumption of disagreement") regarding posthumous donation by a person and the procedure for its withdrawal.

The law enters into force on the day following the day of promulgation, and is effective from January 1, 2019.

The bill was adopted with the proposals of the Committee on Public Health and other legal adjustments.

 

F i r s t  reading bills taken

 

On brokerage business by overseas employment agencies: Draft bill No.6275

Taken on the first reading was there the bill amending a range of Ukraine’s laws framing brokerage activities conducted by international recruitment businesses.

The bill proposes to strengthen control over the activities of companies dealing with overseas employment and to increase the responsibility for violating the legislation in this area in order to prevent trafficking in human beings.

On enhancement of Ukraine’s (National) State Bureau of Investigations: Draft bill No.5395-d

The bill is aimed to solve a whole complex of legal, organizational and personnel issues related to the long-awaited  full-force maiden launch of the State Bureau of Investigations. The draft proposes to amend the laws of Ukraine "On the State Bureau of Investigations" and "On Operational Investigative Activity".

The bill was adopted taking into account the proposals of the Committee on Legislative Support of Law Enforcement.

On currency exchange regulations and control: Draft bill No.8152

The bill is aimed at regulating the ground rules for currency regulations and foreign exchange supervision in Ukraine. The bill is to kill the previous basic currency regulation enactments and amend a range of existing acts of Ukraine related to currency exchange.

The draft law introduces a new regime of currency regulation, defines the categorial and terminological apparatus for the currency regulation, establishes a general regime of currency transactions within the territory of Ukraine, details of foreign exchange transactions, currency values trade transactions, cross-border transfer and transfer of currency values transactions.

The bill also offers to establish the licensing rules for foreign exchange professionals as well as the peculiarities of their foreign exchange supervision (to specify their composition, to regulate the rights and obligations of these entities), exchange of information between subjects of currency transactions, including  bodies of currency oversight, and imposing sanctions for violation of currency regulations.

The draft bill also aims to regulate the rights and obligations of residents and non-residents in the field of currency transactions, including their obligation to submit documents and information to the bodies and agents of currency exchange oversight.

The bill retains for the National Bank of Ukraine the minimum necessary powers enough to prevent a sudden outflow of short-term capital, aiming at the same time at averting excessive pressure on the exchange rate and destabilize the currency market.

The draft proposes to separately define a legal regime for introducing protective measures aimed at reducing the risks to stability of the country’s banking and financial systems and eliminating the negative impact of possible consequences of the pressure on balance of payments, which could threaten achieving the state’s monetary and credit and the exchange rate policies’ objectives.

On renewal of lending: Draft bill No.6027-d

The purpose of the bill is to stimulate active use of lending and reduce the cost of credit resources to facilitate availability of loans to business entities and individuals.
